In the United States, passengers cannot bring a direct action under EU 261/2004 against the airline, as the judicial enforcement of these claims is limited exclusively to the courts of the European Union.33 In addition, an infringement action based on EU 261/2004 can only be brought before the US courts if the airline expressly includes the provision in its contract of carriage.34 para. 4. (e) Nothing in this proclamation shall be construed as affecting the right to asylum, the denial of deportation, or the protection of any person under regulations promulgated pursuant to the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment in accordance with the laws and regulations of the United States. (f) Nothing in this proclamation should be construed to limit the CDC`s authority to impose public health requirements and protocols, including individuals fully vaccinated against COVID-19, persons affected by this proclamation, or persons not covered by this proclamation, such as U.S. citizens, lawful permanent residents, or non-citizens traveling on immigrant visas. Under current federal regulations, pilots must report all illnesses and deaths on board to the CDC before arriving at a U.S. destination. According to CDC`s disease response protocols, if a sick traveler has a serious contagious illness while traveling by air, the CDC works with local and state health departments and international health authorities to contact exposed passengers and crew.

The COVID-19 Response Coordinator and Advisor to the President (COVID-19 Response Coordinator) coordinates the implementation of this section. Heads of Authorities shall inform the COVID-19 Response Coordinator within 7 days of the date of this Order and regularly thereafter of their progress in implementing this Article, including any categorical derogation under paragraph (c) of this Article. Agency heads are encouraged to bring to the attention of the COVID-19 Response Coordinator any questions regarding the scope or implementation of this section. It is my administration`s policy to implement science-based public health measures in all areas of the federal government to prevent the importation, transmission, and spread of COVID-19 in the United States and across the country, including international air travellers.
